General Terms of Service

These General Terms (the "Terms") govern your use of our service.

Introduction

UglyWriting.com is an optical character recognition (OCR) service for images.

The service is published by OnlineCreation, a French limited liability company (SARL) with share capital of €4,500, registered office: 61 rue du Château d'Eau, 33000 Bordeaux, France. SIREN: 520 540 188 (RCS Bordeaux).

Service purpose

The service enables users to perform optical character recognition (OCR) on images. The service uses experimental technology and users must be aware of this before using it. Users are required to manually and carefully review results before relying on them.

Registration and user account

A user account is required to use the service. The user must provide complete and accurate information when creating an account and is responsible for all activities conducted through it.

Use of the service

The user agrees to use free credits to evaluate quality before subscribing. The user waives the right of withdrawal once the first paid credit is consumed. The service provides a best-efforts obligation (submitting the image to AI capable of character recognition) but cannot guarantee a result given the state of the technology.

User data

The only data stored are those provided by the user or resulting from the requested processing, for billing (contact details) or convenience (uploaded images and returned text). All user images are retained until the image deletion function is used, a 90-day period expires, or the account is deleted. Billing data are retained for the legally required period in France.

Intellectual property

The service is the exclusive property of OnlineCreation.

The user agrees to use the service in compliance with applicable laws and in particular not to process documents containing sensitive, confidential or intellectual property protected information unless lawfully owned or duly authorised.

Use of the service grants no intellectual property rights over the results. The user retains ownership of documents submitted if lawfully owned.

Liability and warranties

The user is responsible for all data provided. OnlineCreation takes measures to protect user data but cannot guarantee absence of leakage. The user agrees to stay informed about protecting against fraud and scams.

OnlineCreation shall not be liable for damages arising from use of the service including, without limitation, lost profits, business interruption, data loss or other intangible losses.

The user agrees to properly secure the mailbox of the provided email address.

Term, suspension and termination

The Terms become effective upon user acceptance and remain in force until terminated. OnlineCreation may suspend or terminate an account in case of breach or manifest abuse.

Personal data

Personal data are processed in accordance with the Privacy Policy. OnlineCreation undertakes to protect personal data in compliance with French law and the GDPR.

Documents submitted by the user are processed by Mistral AI SAS (Paris) and stored on Scaleway SAS (Paris) servers.

Updates to the terms

OnlineCreation reserves the right to update the Terms at any time. Users will be informed of material changes.

General provisions

These Terms constitute the entire agreement between the user and OnlineCreation. Any dispute arising out of the Terms shall be subject to the exclusive jurisdiction of the French courts.

Consumer mediation

Force majeure

OnlineCreation shall not be liable for delays or failures caused by force majeure events.

Competent jurisdiction

Any dispute arising from the Terms shall be submitted to the exclusive jurisdiction of the French courts.

Competent court: Court of Bordeaux.

Governing law

These Terms are governed by French law.
