General Terms of Service

UglyWriting.com is an optical character recognition (OCR) service for images.

The service is published by OnlineCreation, a French limited liability company (SARL) with share capital of €4,500, registered office: 61 rue du Château d'Eau, 33000 Bordeaux, France. SIREN: 520 540 188 (RCS Bordeaux).

The service enables users to perform optical character recognition (OCR) on images. The service uses experimental technology and users must be aware of this before using it. Users are required to manually and carefully review results before relying on them.

A user account is required to use the service. The user must provide complete and accurate information when creating an account and is responsible for all activities conducted through it.

Users are invited to use their free credits to assess the quality of the service before any purchase. The service provides a best-efforts obligation (submitting the image to an artificial intelligence able to recognise characters in an image) but cannot guarantee results given the current state of the technology. The conditions of the right of withdrawal are set out in the “Right of withdrawal” section.

The only data stored are those provided by the user or resulting from the requested processing, for billing purposes (contact details) or ease of use (uploaded files and returned text). Uploaded files are automatically deleted 90 days after upload, or earlier if the user deletes them or enables immediate deletion after transcription. Transcriptions are kept until the user deletes them or until the account is deleted. Accounting records are kept for the statutory period of ten (10) years. The service is the exclusive property of OnlineCreation.

The user agrees to use the service in compliance with applicable laws and in particular not to process documents containing sensitive, confidential or intellectual property protected information unless lawfully owned or duly authorised.

Use of the service grants no intellectual property rights over the results. The user retains ownership of documents submitted if lawfully owned.

The user is responsible for all data provided. OnlineCreation takes measures to protect user data but cannot guarantee absence of leakage. The user agrees to stay informed about protecting against fraud and scams.

OnlineCreation shall not be liable for damages arising from use of the service including, without limitation, lost profits, business interruption, data loss or other intangible losses.

The user agrees to properly secure the mailbox of the provided email address.

The above limitations of liability apply to the extent permitted by law and do not deprive consumer users of the rights granted to them by the mandatory provisions of consumer law.

The Terms become effective upon user acceptance and remain in force until terminated. OnlineCreation may suspend or terminate an account in the case of non-use, violation of the Terms and Conditions, or manifest abuse.

Without limitation, manifest abuse includes (among others):

• Using the service for resale or provision of services to third parties.
• Using the service to duplicate intellectual property protected documents for an illegitimate purpose.
• Inappropriate behaviour towards technical support.
• Using the service to process documents containing sensitive or confidential information.
• Use likely to harm OnlineCreation's reputation.
• Use likely to make OnlineCreation an accessory to a civil or criminal offence.

The user can delete its account anytime if it doesn't have any active subscription. Deleting the account forfeits all credits, including unused ones, and does not entitle the user to any refund.

An account is considered inactive when it has no active subscription and the user has not signed in for two (2) years. An inactive account is automatically deleted with all its data, including unused credits. The user is notified by email after 12, 18 and 23 months without signing in, and at least 30 days before deletion; signing in is enough to keep the account.

Personal data are processed in accordance with the Privacy Policy, the General Data Protection Regulation (GDPR) and the French Data Protection Act.

Documents submitted by the user are stored on the servers of Scaleway SAS (Paris) and transcribed by Mistral AI SAS; payments are processed by Stripe.

OnlineCreation reserves the right to update the Terms at any time. Users will be informed of material changes.

These Terms constitute the entire agreement between the user and OnlineCreation. Any dispute arising out of the Terms shall be subject to the exclusive jurisdiction of the French courts. This clause applies subject to the mandatory provisions protecting consumers (see the “Competent jurisdiction” section).

OnlineCreation shall not be liable for delays or failures caused by force majeure events.

Any dispute arising from the Terms shall be submitted to the exclusive jurisdiction of the French courts.

Competent court: Court of Bordeaux.

Consumer users may, at their choice, bring proceedings before the court of the place where they lived when the contract was concluded or when the harmful event occurred (Article R631-3 of the French Consumer Code).

These Terms are governed by French law.

Prices are shown in euros including all taxes (French VAT included), on the website and on the payment page. Payment is due when the order is placed. It is made online through our secure payment provider Stripe, by card (CB, Visa, Mastercard), by digital wallet (PayPal, Apple Pay, Google Pay) or by the other payment methods offered on the payment page depending on the device and country. OnlineCreation never has access to card details. An invoice is issued for each payment and can be downloaded from the personal area.

Purchased credits and credits granted by a subscription are available as soon as payment is confirmed and do not expire as long as the account exists. Monthly free credits do not carry over from one month to the next. A transcription consumes one credit per processed page.

Subscriptions are concluded for one month, tacitly renewed each month on the subscription anniversary date. Each month's price is charged at the start of the period and gives access to the credits of the chosen plan.

Users can cancel their subscription at any time from their personal area, free of charge and without notice: cancellation takes effect immediately, no further payment is taken and credits already granted remain usable. The current month is not refunded, except where the right of withdrawal is exercised under the “Right of withdrawal” section. Changing plan ends the current subscription and starts a new one at the new plan's price.

In accordance with Article L221-18 of the French Consumer Code, consumer users have fourteen (14) days from the conclusion of the contract (purchase of a credit pack or subscription) to withdraw, without giving any reason.

Immediate performance. Before any payment, users expressly request that performance of the service begin as soon as payment is confirmed, and acknowledge that they will lose their right of withdrawal for each fully performed service (Articles L221-25 and L221-28 1° of the French Consumer Code). Each transcription is a fully performed service as soon as its result is delivered: consumed credits are not refundable. They correspond to computing costs incurred with third parties that cannot be recovered.

Effects of withdrawal. If the user withdraws within the period, only the unused credits from the purchase concerned are refunded, in proportion to the price paid; those credits are removed from the account and any subscription is cancelled. The refund is made within fourteen (14) days of receipt of the request, using the payment method used for the purchase.

How to withdraw. Users notify their decision by an unequivocal statement, using the contact form or by post to OnlineCreation, 61 rue du Château d'Eau, 33000 Bordeaux, France. They may use the model form below, but it is not mandatory.

OnlineCreation provides a service in conformity with the contract throughout the period of supply (Articles L224-25-12 et seq. of the French Consumer Code). In the event of a lack of conformity, consumer users may have the service brought into conformity or, failing that, obtain a price reduction or terminate the contract, using the contact form. As the service is presented as liable to produce transcription errors (“Service purpose” section), such errors are part of its announced characteristics.
